<br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />CITY OF ORONO <br />RESOLUTION OF THE CITY COUNCIL <br /> <br />NO. ________________________ <br /> <br /> <br /> <br />MN420-3-705692.v1 <br /> <br />A RESOLUTION APPROVING THE EARLY TERMINATON OF AN AGREEMENT <br />BETWEEN THE CITY OF ORONO AND THE CITY OF THE VILLAGE OF MINNETONKA <br />BEACH FOR BUILDING INSPECTION, ZONING ENFORCEMENT, AND OTHER RELATED <br />SERVICES <br /> <br />WHEREAS, the City of Orono (the “City”) previously entered into that certain contract, dated <br />July 13th, 2010 (the “Contract”), with the City of the Village of Minnetonka Beach (Minnetonka Beach) <br />whereby the City would provide Minnetonka Beach with certain building inspection, zoning enforcement, <br />and other related services; and <br /> <br />WHEREAS, pursuant to the terms of the Contract, it is self-renewing in one-year terms after the <br />initial one-year term and the current term of the Contract expires on or around July 15, 2021; and <br /> <br /> WHEREAS, the Contract provides that either party may terminate the Contract upon 60 days’ <br />written notice to the other party; and <br /> <br />WHEREAS, the City has restructured its building inspection services and intends to contract <br />with a third-party to provide these services to its residents in the future; and intends to terminate the <br />Contract on July 15, 2021; and <br /> <br />WHEREAS, if Minnetonka Beach continues to utilize the services provided by Orono under the <br />Contract, it will be required to transition to a new building inspector now, and will be further required to <br />contract for these services independently in or around July 2021, resulting in a possible second transition; <br />and <br />WHEREAS, staff from the City and Orono have discussed the possibility of early termination, <br />and both parties believe that early termination is in each party’s best interest; and <br /> <br />WHEREAS, the Minnetonka Beach has obtained quotes from multiple service providers that <br />they believe can replace the services being provided by the City under the Contract, and Minnetonka <br />Beach intends to contract with a new service provider upon termination of the Contract; <br />
