<br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />CITY OF ORONO <br />RESOLUTION OF THE CITY COUNCIL <br /> <br />NO. ________________________ <br /> <br /> <br />1 <br /> <br />A RESOLUTION <br />APPROVING A CONDITIONAL USE PERMIT <br />PURSUANT TO <br />MUNICIPAL ZONING CODE <br />SECTIONS 78-644 & 78-916 <br /> <br />FILE NO. LA21 -000011 <br /> <br /> WHEREAS, on January 20, 2021, Kara Honebrink and Jason Fischer (hereinafter <br />the “Applicants”), applied for a conditional use permit for restaurant use pursuant to the City Code <br />for the unit addressed 3420 Shoreline Drive, which is a tenant space within the property addressed <br />3426 Shoreline Drive, and legally described as: <br /> <br />Lot 23, except the West 15 fee thereof, Lots 24, 25, and 26, Block 6, Navarre Heights, <br />Hennepin County, Minnesota, according to the plat thereof. <br /> <br />Subject to an easement for driveway purposes over the W esterly 20 feet of the <br />Southerly 90 feet of said Lot 23, as described in Book 2308 of Deeds, page 528. <br /> <br />Together with an easement for drainage purposes as described in Book 2074 of <br />Deeds, page 450. <br /> <br />Together with all hereditaments and appurtenances belonging thereto (the Property). <br />(hereinafter the “Property”); <br /> <br /> WHEREAS, the Applicants have made application to the City of Orono for a <br />conditional use permit (hereinafter the “CUP”) pursuant to Orono Municipal Zoning Code Section <br />78-644 to allow the existing Lulu’s Pizza restaurant use to expand into adjacent tenant space; <br />and <br /> <br /> WHEREAS, on February 16, 2021, after published and mailed notice in accordance <br />with Minnesota Statutes and the City Code, the Planning Commission held a public hearing, at <br />which time all persons desiring to be heard concerning this application were given the opportunity <br />to speak thereon; and <br /> <br /> WHEREAS, on February 16, 2021, the Planning Commission recommended <br />approval of the restaurant CUP; and <br /> <br /> WHEREAS, on March 8, 2021, the City Council reviewed the application and the <br />recommendations of the Planning Commission and City staff; and <br />
