CITY OF ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. ________________________ <br />1 <br />A RESOLUTION VACATING AN UNIMPROVED <br />ALLEY WITHIN THE PLAT OF <br />FOREST LAKE ADDITION TO SAGA HILL <br />HENNEPIN COUNTY, MINNESOTA <br />FILE NO. LA20-000075 <br />WHEREAS, the city of Orono is a municipal corporation organized and existing under <br />the laws of the State of Minnesota; and <br />WHEREAS, on December 13, 2020, Brian Huisman and Anne Huisman <br />(“Applicant[s]”), made a complete application to vacate a 15 foot by 100 foot unimproved alley <br />adjacent to their property at 1121 North Arm Drive, legally described: <br />That part of the alley as dedicated by FOREST LAKE ADDITION TO SAGA HILL, <br />according to the recorded plat thereof, Hennepin County, Minnesota, lying easterly <br />of the east line of Block 1,said plat FOREST LAKE ADDITIO TO SAGA HILL; and <br />lying northerly of the western extension of the south line of Lot 5, Skarp and <br />Lindquist’s Fernhill, Lake Minnetonka, according to the recorded plat thereof, <br />Hennepin County, Minnesota; and lying southerly of the westerly extension of the <br />north line of Lot 4, said plat Skarp and Linquist’s Fernhill, Lake Minnetonka <br />(hereinafter the “alley”); <br />WHEREAS, on December 17, 2020, notification of the vacation and request for <br />comment was mailed to the Minnesota Department of Natural Resources via certified mail, as <br />required by Minnesota Statutes; and <br />WHEREAS, on February 16, 2021, after published and mailed notice in accordance <br />with Minnesota Statutes and the City Code, the Planning Commission held a public hearing, at <br />which time all persons desiring to be heard concerning this application were given the opportunity <br />to speak thereon; and <br />WHEREAS, on February 16, 2021, the Planning Commission recommended <br />approval of the vacation; and <br />WHEREAS, on March 8, 2021, the City Council reviewed the application and the <br />recommendations of the Planning Commission and City staff; and <br />WHEREAS, the Orono City Council finds the vacation as proposed is in keeping <br />with the public interest and in consideration of the following findings: <br />Council Exhibit A
