To consider a resolution vacating a portion of unimproved alley adjacent to private <br />property at 1121 North Arm. <br /> <br />2. MN§15.99 Application Deadline. The application was received on December 13th, 2020 and <br />considered complete on December 17th. The 60 day review period has been extended to April 16, <br />2021. <br /> <br />3. Background. The subject property, while used as a lakeshore property, is not lakeshore; a <br />portion of a lot owned by the city blocks lake frontage along the south half of the lot, and an <br />unimproved alley blocks lake frontage for the north half of the lot. In January, the City Council <br />accepted the offer to purchase approximately 930 sq. ft. of land adjacent to 1121 North Arm to <br />facilitate a boundary line adjustment, addressing the city lot issue. The purchase price was agreed <br />to as $1.00. <br /> <br />The applicant requests vacation of the unimproved alleyway. A portion (approximately 418 sq. <br />ft.) of this platted alleyway is landward of the ordinary high water line. <br /> <br />In the area to be vacated there are no improvements, the area does not provide access to the lake <br />or other city property, and there is no perceived public use of the property. <br /> <br />4. Planning Commission Vote and Comment. On February 16th, the Planning Commission held a <br />public hearing. Following the public hearing, the Planning Commission voted 7-0 on a motion to <br />approve the vacation. <br /> <br />The members of the Commission were in agreement that given the lack of public benefit for the <br />property and the desire to clean up the boundary line question, the vacation should be approved. <br /> <br />5. Public Comment. As required by State Statute, information on the proposed vacation was sent <br />to the DNR for their comment prior to the Planning Commission public hearing. No comments <br />were received. Staff fielded questions from a neighbor, but no comments were received in favor <br />or opposition to the request. <br /> <br />6. Staff Recommendation. Staff recommends the Council adopt the resolution. With approval of <br />the vacation, staff will prepare a document facilitating the Boundary Line Adjustment for <br />Councils consideration. <br /> <br />COUNCIL ACTION REQUESTED <br />City Council should review the approval resolution and adopt or amend. <br /> <br />Exhibits <br />A.
