To consider an ordinance amendment establishing a deadline for filing an appeal with <br />the courts. <br /> <br />2. Background The City Attorney suggests the City, by ordinance, establish the time period within <br />which an appeal must be filed in district court. The draft ordinance suggests 30 days. This <br />amendment was authorized by the City Council on January 27, 2020. <br /> <br />A party, exhausting its appeal processes with the city, must file an appeal with the district court <br />within 30 days of the final decision they are appealing. <br /> <br />3. Planning Commission Vote and Comment. On March 16th, the Planning Commission held a <br />public hearing. Following the public hearing, the Planning Commission voted 6-0 on a motion to <br />approve the draft ordinance. <br /> <br />The Commission asked if this was in response to any Orono issue. It is not, it is based on a <br />recommendation from the City Attorney after monitoring court cases throughout the state. <br /> <br />4. Public Comment. No comments for or against have been received. <br /> <br />5. Staff Recommendation. Staff recommends the Council adopt the ordinance as drafted. <br /> <br />COUNCIL ACTION REQUESTED <br />City Council should review the ordinance and adopt or amend. <br /> <br />Exhibits <br />A.
