This application is regarding vacation and re-dedication of conservation easements <br />impacting several lots in the Lakeview of Orono development. <br /> <br />2. MN§15.99 Application Deadline. The application was received and was considered to be <br />complete on February 14, 2020. Additionally, the 60-Day review period was extended and now <br />expires on June 13th. <br /> <br />3. Background/ Summary. The applicant is the developer of the Lakeview of Orono development; <br />they still retain ownership of a number of lots in the development. They have identified some <br />areas where they feel a change to the area protected by a conservation easement is necessary, <br />either to preserve the area or to facilitate a more functional building envelope for the property (i.e. <br />Lot 17 Block 3). The proposed changes will result in a net increase in Lakeview of Orono <br />conservation protected area of 16,064 square feet (0.37 acre). The applicant has provided an <br />updated narrative attached as Exhibit C. <br /> <br />4. Planning Commission Vote and Comment. Commissioners were advised that they could <br />approve all, some, or none of the requests. On March 16th the Planning Commission held a public <br />hearing. Following the public hearing the Planning Commission voted 4 to 2 on a motion to deny <br />the requested vacations. Chair Ressler and Commissioner Libby voted in opposition (supporting <br />the vacation). <br /> <br />5. Public Comment. Comments were received and are attached as Exhibit E. <br /> <br />6. Staff Recommendation. If the Council finds the conservation easement adjustments support the <br />original goals of the development, they should approve the vacations. Based on the Planning <br />Commission direction, staff has drafted a denial resolution. <br /> <br />COUNCIL ACTION REQUESTED <br />Motion to adopt or amend the resolution. <br /> <br />Exhibits <br />A.
