Portions of dock located landward of the OHWL shall be considered as a landing, subject 80 <br />to the regulations for landings per section 78-1282. Retaining walls shall not be placed within the 81 <br />shore setbackShore Setback zone. 82 <br />Sec. 78-1282. - Driveways, stairways, lifts and landings. 83 <br />(a) A driveway no wider than eight feet is permitted in the shoreland or tributary setback zone if the 84 <br />property has no other frontage on or access to a public or private road. 85 <br />(b) Stairways and lifts are the preferred alternative to major topographic alterations for achieving access 86 <br />up and down bluffs and steep slopes to shore areas. Stairways, lifts and landings shall be allowed in 87 <br />the shore setbackShore Setback zone and must meet the following design requirements: 88 <br />(1) Stairways and lifts must not exceed four feet in width. 89 <br />(2) Landings for stairways and lifts shall not exceed 32 square feet in area. 90 <br />(3) Canopies or roofs are not allowed on stairways, lifts, or landings. 91 <br />(4) Stairways, lifts and landings may be either constructed above the ground on posts or pilings or 92 <br />placed into the ground, provided they are designed and built in a manner that ensures control of 93 <br />soil erosion. 94 <br />(5) Stairways, lifts and landings must be located in the most visually inconspicuous portions of lots, 95 <br />as viewed from the surface of the public water, assuming summer, leaf-on conditions, whenever 96 <br />practical. 97 <br />(6) Facilities necessary to provide shore area access to physically handicapped persons shall be 98 <br />allowed, provided that the dimensional and performance standards of subsections (1)—(5) of this 99 <br />section are completed in addition to the requirements of the Minnesota Regulations, chapter 1340. 100 <br />(7) A building permit shall be obtained for construction of stairways, lifts and landings regardless 101 <br />of whether such improvements are constructed above, at or below grade. 102 <br />Sec. 78-1283. - Steep slopes. 103 <br />Any applicant requesting a permit for construction of sewage treatment systems, roads, driveways, 104 <br />structures, grading, or other improvements on steep slopes shall provide adequate information to allow the 105 <br />city to evaluate possible soil erosion impacts and development of visibility from public waters before 106 <br />such permit may be issued. Grading plans prepared for steep slopes shall be prepared by a Professional 107 <br />Engineer licensed by the State of Minnesota. When determined necessary, conditions shall may be 108 <br />attached to issued permits to prevent erosion and preserve existing vegetation screening of structures, 109 <br />vehicles and other facilities as viewed from the surface of public waters, assuming summer, leaf-on 110 <br />vegetation. 111 <br /> 112 <br />Sec. 78-1285. - Vegetation alterations. 113 <br />(a) (a) No live tree within 75 feet of the shoreline or within the bluff impact zone with a diameter of 114 <br />six inches or more (or 19 inches in circumference or greater) measured three feet above the ground 115 <br />may be removed without first obtaining a permit from the city staff. 116 <br />Live trees removed within 75 feet of the shoreline shall be replaced based in the following manner: 117 <br />1. Trees less than 36 inches in diameter 1 inch of replacement tree per inch of tree 118 <br />diameter removed 119 <br />2.
