To consider an ordinance revising the regulations related to special events in the city. <br /> <br />2. Background. In December, the City Council started the review of the special event ordinance, <br />an ordinance intended to clarify and where necessary, adjust the review, standards, and <br />enforcement of special events in the city. The City Council reviewed this ordinance in draft form <br />in workshops in January and February. During these reviews, the Council received comments <br />primarily related to fireworks activities, with a focus on notification and compliance with <br />applicable fire codes. <br /> <br />Notable changes to the special event regulations include: <br /> The City Council approves Special Events on city land or using fireworks. The <br />police chief reviews all others, and may refer an event to the Council. <br /> Revisions to the home tour definition, intended to exclude brokers open houses. The <br />City Attorney’s office added “provided that the event is likely to generate parking <br />needs for more than 20 vehicles on city streets at any one time.” To the definition of <br />Open House Tour. <br /> Addition of administrative penalties for violations of special event activities. <br /> Notification of all property owners within 500 feet, to be performed by the applicant. <br /> <br />As noted above, Comments received focused on Fireworks. Related regulations include: <br /> Notification to all special events using fireworks is for all property owners within <br />1000 feet of the launch site. <br /> An insurance policy in favor of the city in the amount of $1,500,000. <br /> <br />During the development of the ordinance, there was discussion regarding the definition of <br />fireworks. The recommended definition refers to the Minnesota State Fire Code, administered by <br />the Fire Chief and the Building Official. The Fire Chief confirms his support for the definition as <br />proposed. <br /> <br />3. Staff Recommendation. Staff recommends adoption of the ordinance as drafted. <br /> <br />COUNCIL ACTION REQUESTED <br />City Council should review the ordinance and adopt or amend. <br /> <br />Exhibits <br />A.
