Page | 11 March 9, 2020 <br /> <br />(2) Alteration activities shall be in accordance with City Code section 79-9 Minimum SWPPP Best 380 <br />Management Practices (BPMs), including, but not limited to: 381 <br />a. Alterations must be designed and conducted in a manner that ensures only the smallest 382 <br />amount of bare ground is exposed for the shortest time possible. 383 <br />b. Mulches or similar materials must be used, where necessary, for temporary bare soil 384 <br />coverage, and a permanent vegetation cover must be established as soon as possible. 385 <br />c. Methods to minimize soil erosion and to trap sediments before they reach any surface 386 <br />water feature must be used. 387 <br />d. Altered areas must be stabilized to acceptable erosion control standards consistent 388 <br />with the field office technical guides of the local soil and water conservation districts and 389 <br />the United States Natural Resources Conservation Service. 390 <br /> 391 <br />(3) Fill or excavated material must not be placed in a manner that creates an unstable slope. 392 <br />(4) Plans to place fill or excavated material on steep slopes must be reviewed by the city engineer 393 <br />for continued slope stability and must shall not create finished slopes of 30 percent or greater. 394 <br />(5) Fill or excavated material must shall not be placed in bluff impact zones, unless approved by the 395 <br />City engineer as part of a slope stabilization project. 396 <br />(6) Any alterations below the ordinary high water level of public waters must first be authorized by 397 <br />the commissioner of the department of natural resources under Minn. Stat. § 103G.245. 398 <br />(7) Alterations of topography may only be permitted must only be allowed if they are accessory to 399 <br />permitted, conditional use or interim use and if they do not adversely affect adjacent or nearby 400 <br />property. 401 <br />(8) Any permit involving the import or export of material, the proposed haul route shall maximize 402 <br />use of County and State roads and be approved by the City Engineer. In addition, , the City 403 <br />Engineer shall review the proposed haul route and document the condition of the city streets prior 404 <br />to import/ export activity. The city may require an escrow deposit to guarantee repair of city 405 <br />streets damaged by the hauling activity. Placement of natural rock riprap, including associated 406 <br />grading of the shoreline and placement of a filter blanket, is permitted if the finished slope does 407 <br />not exceed three feet horizontal to one foot vertical, the landward extent of the riprap is within 408 <br />ten feet of the ordinary high water level, and the height of the riprap above the ordinary high water 409 <br />level does not exceed three feet. A riprap permit shall be obtained per the requirements of section 410 <br />78-969. 411 <br />(Bf) Excavations where the intended purpose is connection to a public water, such as boat slips, canals, 412 <br />lagoons and harbors, are prohibited above the ordinary high water level. Such excavations below the 413 <br />elevation or the ordinary high water level are subject to approval of the Department of Natural 414 <br />Resources and other agencies with concurrent jurisdiction. 415 <br />(Ord.
