Replacement trees shall be at least 1.5 inches in diameter, and of a type approved 122 <br />by the City, provided that at least the equivalent number of replacement trees of a 123 <br />size and nature found acceptable to the staff are planted at the same setback from 124 <br />the shoreline as those removed. Removal of trees that are dead shall not require a 125 <br />permit, but such trees must be inspected by city staff prior to their removal. 126 <br />(b) Intensive vegetation clearing within 75 feet of the shoreline, on steep slopes or within the bluff impact 127 <br />zone within the Shoreland Overlay District is prohibited. Limited clearing of shrubs and trees less than 128 <br />six inches in diameter and cutting, pruning and trimming of trees of any size is allowed to provide a 129 <br />view to the water from the principal dwelling site and to accommodate the placement of permitted 130 <br />stairways and landings, picnic areas, access paths, beach and watercraft access areas, and permitted 131 <br />lockboxes, provided that the screening of structures, vehicles or other facilities as viewed from the 132 <br />water, assuming summer, leaf-on conditions, is not substantially reduced. 133 <br />(Ord. No. 134 <br />178 3rd series, § 14, 10-10-2016) 135 <br />Sec. 78-1286. – Topographic alterations/grading and filling. New Public and Private roads. 136 <br /> (a) Permit Required. A plan showing proper drainage and protection of adjoining properties shall be submitted. 137 <br />The city engineer shall have the authority to refer any requests for land alteration permits to the city council for 138 <br />review and approval in instances where the land alteration appears to create negative impacts or be inconsistent 139 <br />with the goals and policies of the community management plan. An active building permit or separate land 140 <br />alteration permit is required for the following: 141 <br />(a) Grading and filling and excavations necessary for the construction of structures, sewage treatment systems, and 142 <br />driveways under validly issued construction permits for these improvements do not require the issuance of a 143 <br />separate grading and filling permit. However, All grading and filling activity as a part of approved permits for 144 <br />construction of structures, sewage treatment systems, and driveways shall adhere to the grading and filling 145 <br />standards of this article. 146 <br />(b) Grading, filling or excavating of more than 50 cubic yards is prohibited without an interim use permit within 147 <br />the shore setback of the public waters enumerated in section 78-1217. 148 <br />(c) New Public and private roads, driveways, parking areas, and public or private watercraft access ramps 149 <br />shall not be constructed within the shore setbackShore Setback of the public waters enumerated in 150 <br />section 78-1217. If no alternatives exist, such improvements shall be subject to the standard zoning 151 <br />variance review procedure, and such review shall consider the following: 152 <br />(1) Such improvements shall be designed to take advantage of natural vegetation and topography to 153 <br />achieve maximum screening from view from public waters. 154 <br />(2) All roads and parking areas shall be designed and constructed to minimize and control erosion 155 <br />to public waters consistent with the requirements of all agencies with jurisdiction and in 156 <br />accordance with City Code chapter 79. 157 <br />(d) Except for those projects requiring permits for construction of structures, sewage treatment systems 158 <br />and driveways, an administrative land alteration permit will be required as follows: 159 <br />(1) For movement of up to 50 cubic yards of material within the shore setback as per item (b) above, 160 <br />(2) Import/export of 51 through 500 cubic yards of material anywhere within the Shoreland Overlay 161 <br />District, except for within the shore setback. 162 <br />(3) Import/export of more than 500 cubic yards of material within the Shoreland Overlay District 163 <br />interim use permit approval by the city council is required in addition to the administrative land 164 <br />alteration permit. 165 <br />Formatted: Not Highlight <br />Commented [JB10]: Most of the following sections were <br />moved to lines 320… <br />Formatted: Not Highlight
