Mr. Azad is requesting to establish a driveway easement through his <br />current lot at 200 Bederwood so Lot A can have road access. Per City Code (82-254), Public and <br />private rights-of-way, vehicular or pedestrian easements, or surface areas below the ordinary <br />high water mark of any surface water or wetlands or floodplain areas may not be used in <br />order to meet any portion of the minimum lot area requirements. Driveways easements are <br />subtracted from the overall area of the lot. 200 Bederwood is currently substandard in area and <br />subtracting the new driveway easement would decrease the lot area by 8,062 sq.ft. <br /> <br />Practical Difficulties Analysis <br />Applicant Submittal Information: The applicant has identified the creation of a driveway <br />easement for an existing lot of record as practical difficulties supporting the requested variance. <br />Additionally, they have provided supporting documentation regarding Practical Difficulties <br />attached as Exhibit B, and should be asked for additional testimony regarding the application. <br /> <br />Planning Staff Practical Difficulty Analysis: The applicant doid not create either non-conforming <br />lot. The variance requestes is the minimum amount necessary for relief. Regarding practical <br />difficulty, Staff finds the creation of a driveway easement for an existing lot of record is a <br />practical difficult and unique to the property. <br /> <br /> <br />LOT ANALYSIS WORKSHEET <br /> <br />Section 78- 305 - Lot Area/Width: <br /> <br />Application Summary: The applicant is requesting lot area variance because of the desire to <br />create a driveway easement to an existing backlot. <br />Staff Recommendation: Planning Department Staff recommends approval.
