� O� <br /> O O <br /> ��d:.- CITY of ORONO <br /> � ti <br /> �� G'� RESOLUTION OF THE CITY COUNCIL <br /> t� �� No. 3 '� � 0 <br /> kESH� <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon one or more of the above findings or hardships, the Orono City <br /> Council hereby approves variances to Municipal Zoning Code Sections 10.22, Subdivision 2 <br /> and 10.23, Subdivision 6 (B) to permit additions to the existing structure involving a second <br /> story and grants a hardcover variance within the 250-500' setback area at 895.63 s.f. or 18.2%, <br /> a side street setback variance of 35' or 70%, a north side setback variance of 26.5' or 88.3% <br /> and a street setback variance of 5' or 10%. Approval is subject to the following conditions: <br /> 1. A_pplicant shall have completed the legal combination of Lots 1, 2, 3 and 4 of <br /> the Ottoville on Lake Minnetonka plat and the vacated alley prior to applying <br /> for a building permit for the new construction. <br /> 2. Upon application for a building permit, applicant shall provide an updated survey <br /> and hardcover inventory including all approved structural and nonstnictural <br /> improvements. Applicants shall also provide a detailed grading plan showing <br /> existing and proposed contour. <br /> 3. Authorities granted by this variance run with the property not with the applicant, <br /> but are permissive only and must be exercised by application for a building <br /> permit within one year of the date of Council approval, or this variance will <br /> expire on that date (May 13, 1997). <br /> 4. Violation of or non-compliance with any of the terms and conditions of this <br /> resolution shall constitute a violation of the zoning code, shall automatically <br /> terminate any authority granted herein, and shall be punishable as a <br /> misdemeanor. <br /> 5. The undersigned applicant has read, understood and hereby agrees to the terms <br /> of this resolution and on behalf of himself, his heirs, successors and assigns, <br /> hereby agrees to the recording of this resolution in the chain of title of the <br /> property. <br /> Page 4 of 6 <br />
