December 22, 2004 <br /> Dear Craig and Renee Wickland, <br /> I am a Realtor with Coldwell Banker Burnet and represent Steve and Alyson Murray, <br /> who are the new owners of the property at 3760 Bayside Road. Part of the Due Diligence <br /> process involves analysis of property lines in order to establish setbacks and property use. <br /> Our Due Diligence on this property has noted your landscaping encroachment on your <br /> east property line. This encroachment is shown both in the Survey of 1998 and in the <br /> recent staking of the property lines. <br /> Further Due Diligence has noted that your property file at the City of Orono contains a <br /> correspondence from Mr. Gary Valerius dated October 26, 1998. In this letter, Christine <br /> and Gary Valerius outline their concern and awareness of the encroachment. They <br /> reference a letter sent to you in September of that year. In a subsequent conversation <br /> with Mr. Valerius, he informed me that you had spoken with him regarding this issue <br /> acknowledging the encroachment. Mr. Valerius explained to me that upon seeing the <br /> landscaping, and his providing additional screening, he became comfortable with your <br /> casual use of this area, however, he was additionally clear that he in no way provided an <br /> easement or compromised his ownership of the property as described in the survey. <br /> Steve and Alyson Murray have no objection to your current use of this area, subject to <br /> discussion with you in order to gain an understanding of the intended casual use.
