5.3.4.4 Multiple Buildings <br /> An Industrial Discharge Permit may be issued for Permitted Industrial Users for the total wastewater <br /> demand from a Campus of several buildings within the same Community if the property meets one of <br /> the following definitions: <br /> • One parcel of property contains two or more buildings and all buildings must be totally <br /> occupied by the Permitted Industrial User, <br /> • Two or more separate parcels of property with contiguous borders and all buildings must be <br /> totally occupied by the Permitted Industrial User, or <br /> • Two or more parcels of property that are separated only by a body of water(e.g. stream or <br /> river),utility easement or a transportation route(e.g. road, state trail or railroad)and all <br /> buildings must be totally occupied by the Permitted Industrial User. <br /> The properties may be owned or rented by the Permitted Industrial User. SAC for increases in <br /> wastewater demand must be paid by the Community. Communities, on behalf of Permitted Industrial <br /> Users,may be allowed to informally transfer SAC units from one building to another within the <br /> Campus to satisfy SAC liabilities resulting from the MCES' Capacity Demand Review. The transfer <br /> of Credits is subject to the following conditions: <br /> • Each building on the property must maintain the minimum number of SAC units to match its <br /> intended use for that space(See Appendix A for our SAC criteria calculations). If the <br /> intended use for that space is less than 1 SAC, a minimum of 1 SAC unit must be maintained <br /> on the building, <br /> • Each Credit reassignment must be approved by MCES and by the property owner(s)with a <br /> letter of approval from MCES, <br /> • In case of the sale of all or part of the property,MCES will allocate SAC Credits to <br /> individual buildings as it deems appropriate(that building would no longer be a part of the <br /> Permitted Industrial User's Campus),and <br /> • If another business shares a building with a Permitted Industrial User,Credits are not allowed <br /> to be reassigned to another building and that building would no longer be a part of the <br /> Permitted Industrial User's Campus. <br /> Credit reassignments between buildings on a Campus are available for Credit for SAC liability <br /> discovered as a result of MCES' Capacity Demand Review. SAC liability as a result of building <br /> additions or new construction will have SAC Determined using the Commercial criteria as found in <br /> Appendix A. <br /> Once Credits are reassigned to a specific space and Permitted Industrial User,those Credits are added <br /> to the Assigned SAC Baseline and would remain with that Permitted Industrial User as long as that <br /> permit is active. Credits would not be able to be reassigned until the permit is terminated and a New <br /> Use occurs. <br /> Note: A Community may not transfer SAC Credits if a Permitted Industrial User moves operations to <br /> a new location off the Site except if the transfer has been approved as part of a SAC Credit Transfer <br /> as described in Section 5.7. <br /> 5.4 Customer Community Credit System <br /> 5.4.1 Legal Description <br /> Page30 <br />
