If properties are split into multiple parcels, a logical division of the SAC Credit potential will be <br /> determined by MCES. The potential SAC Credits will be based on the most detailed development <br /> plan available, allocating the original parcel's potential Credits based on either the: i)expected <br /> building use(i.e. retail, office,warehouse, etc.); ii) square feet of the buildings; or iii)lot acreages <br /> compared to the original parcel.The potential SAC Credits will be rounded to the nearest whole <br /> number on each of the parcels,not to exceed the original potential Credit amount. <br /> 5.3.2.7 Credit Examples <br /> The following Industrial property examples are for illustration purposes only: <br /> Example I-1 (Assigned SAC Baseline is greater than SAC paid): 30 SAC has been paid by the <br /> Community for a Permitted Industrial User that has an Assigned SAC Baseline of 50 SAC units.The <br /> Permitted Industrial User adds a third shift to increase production and a Capacity Demand Review <br /> indicates 75 SAC units are needed. The Community would be liable to pay MCES for only the 25 <br /> new SAC units.Upon payment by the Community,the Permitted Industrial User would have an <br /> Assigned SAC Baseline of 75 SAC units. <br /> Example 1-2 (permanent process change): In example I-1 above,the same Permitted Industrial User <br /> two years later eliminates a manufacturing process and only needs an Assigned SAC Baseline of 50 <br /> SAC units. If the Community submits a Permanent Process Change request to MCES and it is <br /> approved, 5 Net Credits will be available from the paid SAC (the amount of paid SAC over the <br /> amount needed on the Site). Also,the Industry's Assigned SAC Baseline would be reduced to 50. <br /> Example 1-3 (creditable SAC):Using example I-1 above,the Permitted Industrial User with the <br /> Assigned SAC Baseline of 75 SAC units closes down and is sold to a commercial developer-the <br /> Assigned SAC Baseline is not transferred. Gross Credits available on Site may be a combination of <br /> paid SAC plus any additional capacity from a Non-Conforming Use(i.e. Grandparent Demand flow <br /> documented from around 1973 (+/- 5 years)or Long Continuous Demand Credits by having been <br /> needed in each Capacity Demand Review under the prior permit for at least 10 years.)Only the paid <br /> SAC (55 in this example)not needed on the Site is available as Net Credits. <br /> 5.3.3 Determination Extensions <br /> 5.3.3.1 Extensions <br /> Time extensions to implement wastewater reduction measures are only considered for Permitted <br /> Industrial Users.Upon request,Permitted Industrial Users may be granted a six month extension to <br /> make process changes and review their wastewater demand,thereby potentially lowering their <br /> Community's SAC liability. MCES uses the lesser of the initial SAC liability in the one-year SAC <br /> review letter or the SAC liability determined after a 30-day Volume Study. <br /> 5.3.3.2 Requesting Extensions <br /> The Permitted Industrial User must request extensions in writing to MCES (with a copy to the <br /> Community in which the Permitted Industrial User is located),including: <br /> • a detailed explanation of the circumstances leading to the request, <br /> • a projected timetable to address the demand difference(between the Assigned SAC Baseline <br /> and SAC for the new demand), and <br /> • an acknowledgement that the Permitted Industrial User will need to pay SAC to the <br /> Community at the SAC rate in effect at the end of the extension should the wastewater <br /> demand continue to exceed the Assigned SAC Baseline. <br /> Page I28 <br />
