p CITY OF ORONO <br /> RESOLUTION OF THE CITY COUNCIL <br /> tie �� NO. 7235 <br /> l"IkESHO <br /> A RESOLUTION APPROVING <br /> A CONDITIONAL USE PERMIT <br /> PURSUANT TO <br /> MUNICIPAL ZONING CODE <br /> SECTIONS 78-348 & 78-916 <br /> FILE NO. LA21-000070 <br /> WHEREAS, on August 16, 2021, Terrie DeBaker, Metropolitan Council <br /> (hereinafter the"Applicant"), on behalf of the owner, applied for a conditional use permit <br /> (hereinafter the"CUP") pursuant to Orono City Code for the properties addressed 3447 Crystal <br /> Bay Road legally described as: <br /> That part of Lot 3, Block 1, Wiley's Park, Lake Minnetonka, lying Southerly of a line drawn <br /> from a point on the Easterly line of said Lot 3, distant 35 feet Northerly of the Southeast <br /> corner of said Lot 3, through a point on the Westerly line of said Lot 3 distant 73 feet <br /> northerly of the Southwest corner of said Lot 3; and that part of Lot 4, said Block 1, Wiley's <br /> Park, Lake Minnetonka, lying Southerly of a line drawn from a point on the Easterly line of <br /> said Lot 4 distant 83 feet Northerly of the Southeast corner of said Lot 4, through a point on <br /> the Westerly line of said Lot 4 distant 113.5 feet Northerly of the Southwest corner of said <br /> Lot 4, Hennepin County, Minnesota. (hereinafter collectively the "Property"); <br /> WHEREAS, property is located in the LR-1 C zoning district which permits public <br /> service structures as a conditional use. <br /> WHEREAS, the Applicant has made application to the City of Orono for a CUP <br /> pursuant to Orono Municipal Zoning Code Sections 78-348 and 78-916 to allow the construction <br /> of a building for a lift station <br /> WHEREAS, on November 15, 2021, after published and mailed notice in <br /> accordance with Minnesota Statutes and the City Code, the Planning Commission held a public <br /> hearing, at which time all persons desiring to be heard concerning this application were given <br /> the opportunity to speak thereon; and <br /> WHEREAS, on November 15, 2021, the Planning Commission recommended <br /> approval of the CUP; and <br /> WHEREAS, on December 6, 2021, the City Council reviewed the application and <br /> the recommendations of the Planning Commission and City staff; and <br />
