It appears the erosion control plan submitted with building permit 2010-00733 and
approved by the City is not being followed. The plan indicates there will be two parallel rows of heavy duty silt
fence with steel fence posts and two parallel rows of sediment logs . I observed only one row of non heavydutysilt
fence and wood posts. Additionally, it appears the single row of silt fence is not working and sediment has entered
the creek/wetland. The sediment must be removed from the creek/wetland as soon as is feasible.
Permit number 2010-00733 was issued with the requirement for you to provide the City with a
landscape/planting/seeding plan for the wetland buffer and the additional buffer/native planting areas as per your
approved plan (see Resolution 5587 enclosed). The landscape plan on file indicates the seeding locations;
however, we need additional details regarding seeding method, temporary erosion control to protect the seed as
well as your plan for the ongoing vegetative maintenance. Typically the site should be seeded and stabilized within
7 - 14 days of grading. Please submit a revised landscape plan for review and approval so the planting may be
commenced and site stabilized.
The approved building permit grading plan did not indicate any tree removal or grading on the south side of the
creek and only limited grading was proposed between the new house and the creek. It was our expectation that
these areas were not to be graded. Please submit a revised grading and restoration plan for review and approval.
Additionally, as you're aware and as part of the City's issuance of a certificate of occupancy (CO), the signed
wetland buffer and conservation easement agreement is required to be submitted. A digital file of the wetland
delineation and a written legal description of the wetland and the wetland buffer are also required prior to issuance
of the CO.
In summary, in addition to meeting the requirements outlined by the MCWD in their April 25th communication to
you, revised landscape/planting, grading, erosion control and restoration plans are required to be submitted to me
by Monday May 2"d. Please contact me at 952.249.4627 or mcurtis@ci.orono.mn.us if you have any questions.
Sincerely, .-
Melanie Curtis
Planning & Zoning Coordinator
encl
c: Luke Schwitzer, MCWD Compliance Officer—via email
Michael & Marilyn Huthwaite, 7155 Ainsworth Dr, Germantown, TN 38138
Telephone(952)249-4600 • Fax(952)249-4616
www.ci.orono.mn.us
