Planning &, Zoning Administrator <br /> DATE: March 12, 1992 <br /> is <br /> SUBJECT: Shoreland Ordinance - Flexibility Request <br /> The City of Orono is requesting flexibility consideration in the <br /> following general categories keyed to the ordinance review checklist: <br /> A. Definitions - Flexibility in terminology, concept or standard is <br /> requested for: <br /> 1. "Building Line" - (Omit definition) Our current code uses <br /> the concept of required yards and setbacks; the definition <br /> of building line in the model ordinance is somewhat • <br /> synonymous with setback line. We have not used the term <br /> "building line" in the code. <br /> 2. "Steep Slope" - Orono's current subdivision code allows <br /> slopes of up to 18% or greater as dry buildable land. For <br /> consistency, we have defined steep slopes as those of 18% or <br /> greater rather than 12%. <br /> 3 . "Planned Unit Development" - Our current code uses the terms <br /> planned residential development and planned unit development <br /> to define residential PUD' s and non-residential PUD' s. <br /> B. Shoreland Management Classification System - No flexibility <br /> requested. <br /> C. Land Use Districts - No flexibility requested. Note that the <br /> City has chosen to create an overlay district rather than revise <br /> boundaries/standards of existing zoning districts. <br /> Dl. Zoning Provisions. Flexibility is requested in the areas of: , <br /> Structure setback from right-of-way lines. Existing <br /> development and current codes would be very inconsistent <br /> with a 50' structural setback from county roads in lakeshore <br /> areas. Likewise, our current code allows certain principal <br /> and accessory structures within 10-15' of local streets, <br /> hence a 20' setback requirement would. be inconsistent and <br /> make many developed properties nonconforming. <br /> Structure height limit. Current- code allows a 30' height <br /> rather than the 25' height limit.suggested. The character <br /> of typical residential construction in the Lake Minnetonka <br /> area would change drastically with this decreased limit. <br /> •. <br />
