To consider a subordination agreement over specific drainage/ utility easements at 1485 <br />Sixth Avenue N. <br /> <br />2. Background. In 1996 a pond was completed at 1485 Sixth Avenue for stormwater and water quality <br />purposes. An easement was created, but never recorded. This was noted by the watershed district during <br />the review of the Long Bridge Plat (LA21-000021). The Newell’s have agreed to provide the easement as <br />requested by the Watershed District. Additionally, there are two existing conservation and flowage <br />easements on the property. <br /> <br />The MCWD has requested the City sign a subordination agreement, placing the Watershed District’s <br />interests in the easements above the City’s. Because the Watershed district is responsible for <br />administering/ maintaining stormwater management system, including the pond and associated controls, <br />staff supports the subordination agreement in order to ensure there are no areas of overlap/ confusion. <br /> <br />3. Staff Recommendation. Staff recommends the Council authorize the Mayor to sign the agreement. <br /> <br />COUNCIL ACTION REQUESTED <br />City Council should authorize the Mayor’s signature for the agreement. <br /> <br />Exhibits <br />A.
