Consider a resolution that completes a land sale of city property and boundary line <br />adjustment for the adjacent property owner at 1121 North Arm. <br /> <br />2. Background. In June 2020, the applicants approached the city to vacate and complete a boundary <br />line adjustment to address a platting anomaly adjacent to their home. Their property, appearing to have <br />lake frontage, is actually separated from the lake by a platted lot and platted right of way owned and <br />managed by the city. (Staff report and minutes, Exhibit D) <br /> <br />In January, 2021, the Council favorably reacted to a request to complete a boundary line adjustment that <br />sold approximately 878 sq. ft. of land to the owner of 1121 North Arm Drive for $1.00, and directed the <br />City Attorney to confirm title to the property. (Staff report and minutes, Exhibit E) <br /> <br />In March 2021, the City Council approved a resolution (Resolution 7170) that vacated a portion of the <br />platted right of way. <br /> <br />Since March, the applicant and the City Attorney’s office have been working together on the proper <br />documentation to facilitate the direction of the Council. The draft resolution and quit claim deed, <br />attached as Exhibits A, and B, respectively, were developed to vacate and sell city land to the owners of <br />1121 North Arm. The resolution also waives the Planning Commission review of the sale of city <br />property. Because of this, the Resolution must be approved by a 2/3 vote. <br /> <br />3. Staff Recommendation. Staff recommends the Council adopt the resolution and Quit Claim Deed as <br />drafted. <br /> <br />COUNCIL ACTION REQUESTED <br />City Council should review the approval resolution and adopt or amend. <br /> <br />Exhibits <br />A.
