CITY OF ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. ________________________ <br />1 <br />A RESOLUTION APPROVING THE <br />GENERAL CONCEPT PLAN, AND GRANTING PRELIMINARY PLAT, ZONE CHANGE <br />APPROVAL <br />FOR PROPERTY LOCATED AT <br />2060 WAYZATA BLVD WEST <br />-FILE NO. LA21-000042 <br />WHEREAS, CBS MN Properties, a Minnesota limited liability company (hereinafter the <br />"Developer") is owner of the property located at 2060 Wayzata Blvd West within the City of Orono <br />(hereinafter the "City") and legally described as follows: <br />Lots 1-6, Block 1, Amber Woods Office Center (hereinafter the "Property"); and <br />WHEREAS, the Developer has requested General Concept Plan, Zone Change, and <br />Preliminary Plat Approval for development of the Property. Proposed is a rezoning from B-6 PUD, <br />Highway Commercial to RPUD Residential Planned Unit Development District for construction of a 48- <br />unit market rate apartment building; and <br />WHEREAS, on May 19, 2021 the Developer filed a complete formal application with the <br />City for rezoning, concept plan and preliminary plat approval for a 48 unit market rate apartment building <br />on the Property; and <br />WHEREAS, after due published and mailed notice in accordance with Minnesota Statutes <br />462.358 et. seq. and the City of Orono Zoning and Subdivision Codes, the Orono Planning Commission <br />held a public hearing for the application and reviewed it on June 21, 2021, at which time all persons desiring <br />to be heard concerning this application were given the opportunity to speak thereon; and <br />WHEREAS, the Planning Commission information, published for the June 21, 2021 <br />meeting, including staff report and exhibits, is incorporated by reference; and <br />WHEREAS, the Planning Commission on June 21, 2021 recommended on a vote of 7-0 <br />that the Council approve the rezoning to RPUD Residential Planned Unit Development District; grant <br />general concept plan, and preliminary plat approval subject to a number of conditions and <br />recommendations; and <br />WHEREAS, the Orono City Council reviewed the sketch plan for the Property in April <br />2021, and has reviewed the formal applications at its regular meeting on July 12, 2021; and <br />WHEREAS, the Orono City Council reviewed the project for height calculation on July <br />26, 2021; and
