The current request is to waive Planning Commission review of a Conditional Use <br />Permit and/or Variance for the modified application pursuant to City Code Sections 78-122 and <br />78-912. <br /> <br />2. MN§15.99 Application Deadline. The <br />application was received on March 17, and <br />considered to be complete on March 30th. Due to <br />the tabling on May 10th the 60-day deadline has <br />been extended until July 28, 2021. <br /> <br />Background/ Summary. On May 10th the <br />Council discussed the applicant’s request for <br />variances for two separate accessory buildings. <br />The Council supported the setback variances <br />relating to the reconstruction of the carriage house, <br />however did not support relocation of the <br />boathouse away from the lake. <br /> <br />In order to comply with the Floodplain <br />Regulations and maintain the same location and <br />footprint, the applicant will either need to elevate <br />the boathouse on fill (which will require a <br />variance) or create a floodable foundation which <br />requires a conditional use permit. <br /> <br />The applicant and property owner are in the <br />process of evaluating the project to determine their <br />best path forward. Because both options require an additional public hearing, staff is requesting <br />the Council waive the Planning Commission’s review of the public hearing and hold the public <br />hearing following the required publication. The Ordinance allows the Council to waive Planning <br />Commission review, by unanimous consent. <br /> <br />3. Staff Recommendation. Staff recommends the Council vote to waive reference of the additional <br />public hearing to the Council on June 14th. <br /> <br />COUNCIL ACTION REQUESTED <br />Motion to waive the Planning Commission’s review of the forthcoming land use application relating to <br />LA21-000026 (Boathouse). <br /> <br />Exhibits <br />Exhibit A.
