To adopt the resolution approving the final plat and Development Contract for Orchard <br />Creek. <br /> <br />2. MN§15.99 Application Deadline. The application was received on April 26, 2021 and considered <br />to be complete on July 7, 2021. The 60-Day review period will expire on September 6, 2021. <br /> <br />3. Background. The City Council approved the preliminary plat for this project via resolution 7119 in <br />September, 2020. Since then, the applicant has submitted the Final Plat application and the required <br />documents and revisions. The City Attorney has drafted a Development Contract, and reviewed the <br />Homeowners Association documents. The City Engineer has reviewed and approved the construction <br />plans. The Finance Director has confirmed that there are no outstanding fees or charged to the property. <br />Permits for the connection to the sanitary sewer system have been approved by the Metropolitan Council. <br /> <br />4. Public Comment. To date, no comments for or against the proposal have been received. <br /> <br />5. Staff Recommendation. Staff recommends the Council adopt the resolution, approving the plat of <br />Orchard Creek, adding 5 single family residential lots. Staff also recommends approval of the <br />Development Contract. <br /> <br />COUNCIL ACTION REQUESTED <br />City Council should review the approval resolution and adopt or amend, and authorize Mayor Walsh to <br />sign the Development Contract. <br /> <br />Exhibits <br />A.
