Regulating the use of water during periods of water shortage. <br />(a) Purpose. In order to avoid a water shortage due to inadequate capacity in water systems, to ensure an <br />adequate water supply for fire protection, to protect the environment of Lake Minnetonka, to ensure the <br />protection of subterranean aquifers, to maintain the quality of domestic water supplies, and to protect the <br />general health, safety and welfare of the residents, the regulations on nonessential water uses prescribed in <br />this section shall apply during periods of water shortages. <br />(b) Implementation of restrictions. Whenever the city council shall determine that a shortage of water threatens <br />the city, it may enact by resolution the restrictions for nonessential water use set forth in this section. The <br />resolution shall become effective 24 hours after passage and publication. The resolution shall contain the <br />following information: <br />(1) Uses of water that will be restricted; <br />(2) Types of water supply which will be restricted, such as the public water system, private wells, lakes or <br />other surface water systems; <br />(3) Times during which the restriction will apply; <br />(4) Whether the use restrictions will apply to all property in the city or will vary depending upon location <br />or identification of property; <br />(5) When the restrictions will be implemented and when they will terminate; and <br />(6) Whether the restrictions will be voluntary or involuntary. <br />(c) Notification of public. Whenever the city council enacts the restrictions in this section, it shall take such <br />action as is reasonably practicable to notify the general public of the restrictions. The notice shall be posted <br />on the city's bulletin board and shall be published in the local newspaper. The notice shall include the <br />information described in subsections (b)(1)—(6) of this section. <br />(d) Types of water supply. The restrictions in this section shall, at the discretion of the city council, apply to the <br />public water system, private wells, lakes or other surface water systems, or any combination. <br />(e) Restrictions. <br />(1) During a water shortage, the city council may order one or any combination of the following <br />restrictions: <br />a. A complete or partial ban on water use for watering lawns, trees and shrubs, irrigation, car <br />washing, filling swimming pools, air conditioning, other uses determined by the city to be <br />nonessential, or any combination; <br />b. An odd/even watering ban in which residents of addresses ending in an even digit may water on <br />even-numbered calendar days and residents of addresses ending in an odd digit may water on <br />odd-numbered calendar days; <br />c. A limitation of water use for specified hours of the day; <br />d. A voluntary or involuntary restriction; <br />e. A use restriction applicable to all or part of the city or based on land use or property <br />identification; and <br />f. Any other appropriate restrictions.
