Page 1 <br />A RESOLUTION APPROVING THE <br />GENERAL CONCEPT PLAN, AND GRANTING PRELIMINARY PLAT, ZONE <br />CHANGE APPROVAL <br />FOR PROPERTY LOCATED AT <br />2060 WAYZATA BLVD WEST <br />- FILE NO. LA21-000042 <br /> <br />WHEREAS, CBS MN Properties, a Minnesota limited liability company <br />(hereinafter the "Developer") is owner of the property located at 2060 Wayzata Blvd West within <br />the City of Orono (hereinafter the "City") and legally described as follows: <br /> <br />Lots 1-6, Block 1, Amber Woods Office Center (hereinafter the <br />"Property"); and <br /> <br />WHEREAS, the Developer has requested General Concept Plan, Zone Change, <br />and Preliminary Plat Approval for development of the Property. Proposed is a rezoning from B-6 <br />PUD, Highway Commercial to RPUD Residential Planned Unit Development District for <br />construction of a 48- unit market rate apartment building; and <br /> <br />WHEREAS, on May 19, 2021 the Developer filed a complete formal application <br />with the City for rezoning, concept plan and preliminary plat approval for a 48 unit market rate <br />apartment building on the Property; and <br /> <br />WHEREAS, after due published and mailed notice in accordance with Minnesota <br />Statutes 462.358 et. seq. and the City of Orono Zoning and Subdivision Codes, the Orono Planning <br />Commission held a public hearing for the application and reviewed it on June 21, 2021, at which <br />time all persons desiring to be heard concerning this application were given the opportunity to <br />speak thereon; and <br /> <br />WHEREAS, the Planning Commission information, published for the June 21, <br />2021 meeting, including staff report and exhibits, is incorporated by reference; and <br /> <br />WHEREAS, the Planning Commission on June 21, 2021 recommended on a vote <br />of 7-0 that the Council approve the rezoning to RPUD Residential Planned Unit Development <br />District; grant general concept plan, and preliminary plat approval subject to a number of <br />conditions and recommendations; and <br /> <br />WHEREAS, the Orono City Council reviewed the sketch plan for the Property in <br />April 2021, and has reviewed the formal applications at its regular meeting on July 12, 2021; and
