To consider a variance for a deck that encroaches into the side, lake, and average lake <br />setbacks, and with hardcover greater than 25%. <br /> <br />2. MN§15.99 Application Deadline. The application was received on March 17, 2021 and considered <br />to be complete on April 12th. The 60-Day review period will expire on June 11, 2021. <br /> <br />3. Background. About one-half of the applicant’s house, <br />including the deck, encroaches into the 0-75 lake yard, and <br />approximately 2-5 feet of the house, including all of the deck is <br />lakeward of the average lakeshore setback. The house is 5 feet <br />from the side property line, a setback of 7.5 feet is required. <br />Existing impervious surface is 33% of the land area, 25% is <br />permitted. <br /> <br />The applicant is proposing to replace an irregular shaped deck <br />on her property to, in part, accommodate her wheelchair bound <br />mother. The new deck would be 8’ x 18’, or 144 sq ft. <br />Proposed hardcover levels are 33.4% of the lot, an increase of <br />30 sq ft over existing level (33%). This hardcover level <br />reflects a hardcover exclusion for 19 sq ft of deck over grass, the rest of the deck is over a lower level <br />patio. <br /> <br />4. Planning Commission Vote and Comment. On April 17th, the Planning Commission held a public <br />hearing. Following the public hearing, the Planning Commission voted 6-0 on a motion to deny the <br />requested variance as proposed. The original proposal was for a 288 sq ft deck, running the entire length <br />of the house, increasing hardcover to 34.2%. <br /> <br />The members of the Commission were in agreement that variances to the lake, average lake, and side yard <br />setbacks could be supported, but they could not support an increase in hardcover in the lake yard. <br /> <br />5. Public Comment. Comments from the neighbors were received and are attached as Exhibit G. <br /> <br />6. Staff Recommendation. The applicant has reduced the proposed encroachments and hardcover <br />levels. The Council should direct staff to draft a resolution, approval if this reduction is acceptable, denial <br />if it not. <br /> <br />COUNCIL ACTION REQUESTED <br />City Council should direct staff to draft a resolution of approval or denial. <br /> <br />Exhibits <br />A.
