Provide an update on the application to place a private dock on public right of way, on Big <br />Island. <br /> <br />2. MN§15.99 Application Deadline. The application was received on February 8th and considered to <br />be complete on February 16th. The applicant has agreed to extend the review timeline; the review period <br />now expires on August 15, 2021. <br /> <br />3. Background. The applicants own 480 Big Island, a non-lakeshore property on Big Island. Pursuant <br />to City Code Section 78-567, the applicants request approval to place a private dock on the right-of-way <br />(Bay Place). Big Island is zoned RS, which is the only district where a non-lakeshore property is <br />permitted access to the lake; the city may issue a permit for a dock in the right of way, or the property <br />owner may obtain an easement over private property. At the Council’s April 12th meeting, the applicants <br />presented their request. In addition there were several members from the public present offering input. <br />Following the discussion, the City Council tabled the application and directed the applicant to work with <br />the other Big Island property owners to develop a solution or policy addressing dock access needs for <br />inland property owners. <br /> <br />4. Update. The applicants have held meetings with the small group of Big Island neighbors who have <br />been involved to date. They met on April 28th and May 5th. The applicant has provided a written update, <br />attached as Exhibit A. They have not yet developed a solution to the issue. <br /> <br />5. Public Comment. Additional written comments have been received from Ms. Farnes since the April <br />12th Council meeting.
