Consider an ordinance amendment removing the requirement for a conditional use permit to place <br />a shower or bathtub in an accessory building, and <br />b. Adopt a summary ordinance for publication. <br /> <br />2. Background. Currently, placing a shower or bathtub in an accessory building requires a conditional <br />use permit. The net effect of that action is a resolution that requires the property owner to record a <br />covenant against the property that states the property will not be: <br /> <br />1. Used for a home occupation unless specifically approved by the city or if allowed by this Code. <br />2. Used as a dwelling unless a guest house conditional use permit is obtained. <br />3. Rented, leased or otherwise provided for use as a dwelling under any circumstances. <br />These requirements can be written into the code without the 6+ week timeline of going through the <br />conditional use permit process. There have been 8 such requests in the last 15 months. <br /> <br />Additionally, given the concern of additional density, the draft ordinance updates the definition of a <br />guest house, incorporating by reference the Minnesota State Building Code. If an accessory building <br />has all of the facilities for a dwelling as defined by the Building Code, it is a guest house, and would <br />require a conditional use permit. In practice, we anticipate the modification of plans for properties <br />that do not meet the guest house requirement. <br /> <br />Finally, because the draft ordinance is lengthy, a summary ordinance has been prepared, for <br />publication. <br /> <br />3. Planning Commission Vote and Comment. On April 17th, the Planning Commission held a public <br />hearing. Following the public hearing, the Planning Commission voted 6-0 on a motion to approve the <br />ordinance amendment as proposed. <br /> <br />4. Public Comment. No comments for or against the proposal have been received. <br /> <br />5. Staff Recommendation. Staff recommends the Council adopt the Ordinances as drafted. <br /> <br />COUNCIL ACTION REQUESTED <br />City Council should review the ordinance and adopt or amend. <br /> <br />Exhibits <br />A.
