MINUTES OF THE <br />ORONO CITY COUNCIL MEETING <br />Monday, April 12, 2021 <br />6:00 o’clock p.m. <br />___________________________________________________________________________________ <br /> <br />16. LA21-000016 – Schimmel Construction o/b/o David & Kathryn Wiemer, 1405 Rest Point Road, <br />Variances <br /> <br />David & Kathryn Wiemer, Applicants, were present. <br /> <br />Barnhart presented a summary packet of information and shared that the Planning Commission <br />recommended denial of the variances. The project includes an addition on to the south side of the <br />property and a deck on the lakeside portion. At the time the Commission reviewed it there was a rear <br />street yard setback, a lake setback (most of the house is in the 0-75), and also a hardcover variance; the <br />Commission did not have a lot of issue for the addition portion of the project but did have concerns with <br />the additional hardcover. Since the Planning Commission meeting, the Applicant has revised their project <br />and removed the need for the hardcover variance. They still need a straight rear yard setback and the lake <br />yard setback. Staff has changed the recommendation for denial to the Planning Commission to an <br />approval of the project based on those changes. <br /> <br />Walsh asked about the other piece getting closer to the lake; he believes it is the stairway. <br /> <br />Barnhart noted the Applicant is proposing some changes to the deck including some flagstone pathways <br />within the 0-75 instead of a structure. <br /> <br />Johnson asked if they are changing existing hardcover. <br /> <br />Barnhart replied they were conforming in hardcover and with the proposed addition they would be above <br />the hardcover limit. Now they have adjusted the drawing so they are at the 25% maximum for hardcover. <br /> <br />Crosby asked how much of the existing hardcover is within the 0-75. <br /> <br />Barnhart pointed it out on screen and said it is somewhat challenging to fit some hardcover without some <br />of it in the 0-75. <br /> <br />Walsh noted that was his concern and he spoke to the Applicant after the last Council meeting and said if <br />they can get it in to the 25% and knowing that the house is within the 0-75 they do not want anything to <br />get any closer than it is today. <br /> <br />Barnhart shared the Applicant reduced the size of the deck proposal 240 square feet to make it fit. <br /> <br />16. LA21-000016 – Schimmel Construction o/b/o David & Kathryn Wiemer, 1405 Rest Point Road, <br />Variances – Continued <br /> <br />David and Kathryn Wiemer thanked the Council and said the feedback and guidance from the Planning <br />Commission and Ms. Curtis has been extremely helpful to come up with the revised plan. Given the <br />challenges of the lot with the lake and road setbacks, the revised plan now meets that 25% hardcover <br />requirement and will also work for the goal of having a four season porch and have a deck to enjoy the <br />outdoor areas of the yard without sinking in to the ground in their chairs. <br /> <br />Johnson moved, Seals seconded, to approve LA21-000016, 1405 Rest Point Road, Variances <br />VOTE: Ayes 4, Nays 0. <br />
