and any other party having a recorded interest in the Property. The modified or <br /> amended Declaration must be approved by the City. <br /> 9. Severability. Invalidation of any covenant,condition, or restriction set forth <br /> herein by judgment or court order shall in no way affect any of the other <br /> provisions hereof, which shall all remain in full force and effect. <br /> 10. Warranties of Title. Declarant represents and warrants that it is the lawful <br /> Owner of the Property and has the full right,title and authority to enter into this <br /> Declaration. Any mortgage lender, or other party with an interest in the Property, <br /> if any, shall consent to this Declaration,which consent shall be attached and made <br /> a part of this Declaration. <br /> 11. Notices. All notices, communications, demands and requests permitted or <br /> required to be given to the Owners under this Declaration shall be in writing and <br /> shall be deemed to have been given(a)when personally delivered, or(b) one(1) <br /> business day after being delivered to a reliable and recognized overnight courier <br /> or messenger service which provides receipts of delivery,with fees prepaid or <br /> charged to the sending party, or(c)three (3)business days after being deposited <br /> in the United States mail in a sealed envelope with registered or certified mail <br /> postage prepaid thereon, addressed to the Owners at such Owner's Lot. <br /> 12. Governing Law. The laws of the State of Minnesota shall govern the <br /> interpretation,validity,performance and enforcement of this Declaration. <br /> 13. Counterpart Signature Pages. This Declaration may be executed in one or <br /> more counterparts, each of which shall be deemed an original, and all of which <br /> together shall constitute one and the same instrument. <br /> IN WITNESS WHEREOF,Declarant has executed this Declaration the day and year <br /> first above written. <br /> 218302v1 <br />
