I <br />(reserved for recording information) <br />DECLARATION OF EASEMENT <br />THIS DECLARATION OF EASEMENT is made this --(a day of <br />Au k u % r_, 2015, James D. MacKinnon and Pamela A. MacKinnon, husband and wife, <br />and Catharine A. MacKinnon, a single person, and Leonard D. MacKinnon, a single person <br />("Declarants"). <br />WHEREAS, Declarants are the fee owners of land located in Hennepin County, <br />Minnesota (the "Property"), legally described as follows: <br />Outlot D, Kintyre Two, Hennepin County, Minnesota <br />WHEREAS, Declarants have marketable title to the Property, free and clear of all liens, <br />mortgages, encumbrances; and <br />WHEREAS, Declarants have platted the Property into a subdivision entitled Kintyre <br />Two; and <br />WHEREAS, as a condition of approval of the plat for Kintyre Two by the City of Orono, <br />Declarants are required to dedicate this easement; <br />WHEREAS, Declarants desire to create, impose and grant a perpetual easement for <br />public access; <br />NOW, THEREFORE, Declarants hereby state and declare: <br />1. Grant of Easement. Declarants hereby declare and create: (a) perpetual, non- <br />exclusive easement over the Property for the benefit of the public, for access over, under and <br />across the Property ("Easement Area"); and (b) a perpetual; non-exclusive easement over the <br />Property for the benefit of the City for (i) public ingress, egress and access; (ii) road, drainage <br />and utilities purposes and uses, including the right to construct an maintain the same, including <br />but not limited to a full and free right and authority to enter upon the Easement Area to construct <br />install, maintain, operate and repair the road or utilities, and any and all appurtenances, including <br />drainage control structures, incidental and related thereto; and (iii) ingress and egress over the <br />Easement Area :For inspection by the City of any portion of the Easement Area, animal control, <br />snow removal, :maintenance, repair and replacement of the road or utilities on the Easement <br />Area, and exercise of any rights or remedies granted to the City by this Declaration or any future <br />amendments or easements. <br />1 <br />
