The City Council finds that the conditions existing on this property are peculiar to <br /> it and do not apply generally to other property in this zoning district; that granting <br /> the variance would not adversely affect traffic conditions, light, air nor pose a fire <br /> hazard or other dan�er to neighboring property; would not merely serve as a <br /> convenience to the applicants, but is necessary to alleviate a practical difficulty; is <br /> necessary to preserve a substantial property right of the applicants; and would be <br /> in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan <br /> of the City. <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon one or more of the above findinas, the Orono City Council hereby �rants <br /> variances to Orono Municipal Zoning Code Section 78-305 (B) to allow construction of an <br /> addition to the existing home resultin� in a 8.4-foot setback on the south side where a 30-foot <br /> side yard setback is normally required and an 8.4-foot setback currently exists, subject to the <br /> following conditions: <br /> L Council approval is based on the survey and buildinQ p�ans submitted by the Applicants <br /> and annotated by City staff, attached to this Resolution as Exhibits A & B. Any <br /> amendments to the site plan which are not in conformity with City codes will require <br /> further Planning Commission and City Council review. <br /> ?. No hardcover variances are granted. The Applicants must conduct hardcover removals in <br /> order to achieve a conforminv ?�°�o hardcover level within the 7�`-2�0' zone. Hardcover <br /> within the ?�0'-500' zone shall not increase above 30%. <br /> 3. The Applicants acknowledge the awkward configuration of the proposed dnveway and <br /> acknowled�e that chan�es to the driveway resulting in hardcover in excess of 2�% will <br /> not be approved. � <br /> 4. The Applicants shall submit a detailed drainage and �rading plan with the buildin�permit <br /> application to ensure no ne�ative impacts to the adjacent proeprty. <br /> �. The Applicants shall submit a planting plan with the building permit application for <br /> screeninD the proposed addition from the property to the south. <br /> 6. The building plans submitted for building permit will be reviewed to ensure compliance <br /> with the City's buildina heiahf and number of stories regulations. <br /> Paae 3 of 5 <br />
