COUNCIL ACTION REQUESTED <br /> To give direction to Building and Zoning Staff whether the applicant should be permitted to continue <br /> and build above the existing foundation. <br /> Options for Council Action: <br /> l. To permit the applicant to continue based on the intent of the variance approvals and no <br /> exterior alterations are proposed. This option would limit the size of the house to the plans <br /> approved with the variance. Staff is comfortable with this option based on the assumption <br /> the building would be constructed in accordance with the plans approved by the Council per <br /> Resolution 4416. <br /> 2. To advise the applicant to submit a new land use application with the direction based on the <br /> fact the entire building was removed and a small portion of the foundation would be replaced <br /> if it is considered new construction and should require lot width and lot area variances for <br /> new construction on a non-conforming lot. The lot is a one acre lot in the two acre zoning <br /> district and is less than the 200' minimum lot width required. If the Council would choose <br /> this option it would be appropriate to discuss the issue of the building encroaching into the <br /> average lakeshore setback.
