!�� <br /> /� �ll�' <br /> 0 0 <br /> �,,. - C ITY of ORONO <br /> � <br /> �'',� 4 �'� RESOLUTION OF THE CITY COUNCIL <br /> �kESH�¢� N O. � � � � <br /> CONCLUSIONS, ORDER, AND CONDITIONS <br /> Based upon one or more of the above findings, the Orono City Council hereby grants <br /> variances to 1�lunicipal Zoning Code Section 10.22,Subdivision 1(B)and Section 10.56,Subdivision <br /> 16 (C)(6) to allow the construction of an addition to the gaza�e and an addition to the second story <br /> of the existin� home that encroaches 20' into the averaje lakeshore setback and per Section 10.22, <br /> Subdivision 2 and Section 10.56, Subdivision 16 (L)(2) to allow �,74� s.f. (28.27%) hardcover in <br /> the 75-2�0' lakeshore setback area where 6,241 s.f. (30.7%) exists and �,081 s.£ (25%) is allowed <br /> and per Section 10.23, Subdivision 6(B)to allow a side yard setback of 10.62'to the north property <br /> line and 9.93' setback to the south property line where 30'setback is required. Approval was subject <br /> to the followin� conditions: <br /> 1. Council approval is based on the site plan submitted by the applicants attached to this <br /> resolution on Page 6. Any amendments to the site plan may require further Planning <br /> Cominission and City Council revie�v. <br /> 2. Authorities granted by this variance run with the property not�vith the applicants,but <br /> are permissive only and must be exercised by application for a building permit within <br /> one year of the date of Council approval, or this variance will expire on that date <br /> (January 24, 2001). <br /> 3. Violation of or non-compliance with any of the terms and conditions of this variance <br /> shall constitute a violation of the zoning code, shall automatically terminate any <br /> authority granted herein, and shall be punishable as a misdemeanor. <br /> 4. The undersigned applicants have read, understood and hereby agree to the terms of <br /> this resolution and on behalf of themselves, their heirs, successors and assigns, <br /> hereby agree to the recording of this resolution in the Chain of Title of the property. <br /> Pa�e 3 of 6 <br />
