The granting of the proposed variance will not in any way impair health,safety, comfort or <br /> morals, or in any other respect be contrary to the intent of this chapter. The use of the <br /> property,along with all other proposed elements in the Camp TEKO Master Plan,are <br /> intended to improve the health, safety,comfort,and morals of all users compared to the <br /> existing camp as it currently exists. <br /> 12. The granting of such variance will not merely serve as a convenience to the applicant, but is <br /> necessary to alleviate demonstrable difficulty.The applicants have requested the variances <br /> necessary to support and improve their use with minimal impact to the surrounding area. <br /> The Commission may recommend or Council may impose conditions in granting of variances. Any <br /> conditions imposed must be directly related to and must bear a rough proportionality to the impact <br /> created by the variance. No variance shall be granted or changed beyond the use permitted in this <br /> chapter in the district where such land is located. <br /> Public Comments <br /> To date, no public comments have been received. <br /> Issues for Consideration <br /> 1. Does the Planning Commission find that that the property owner proposes to use the <br /> property in a reasonable manner which is not permitted by an official control? <br /> 2. Does the Planning Commission find that the variance(s), if granted, will not alter the <br /> essential character of the neighborhood? <br /> 3. Does the Commission find it necessary to impose conditions in order to mitigate the <br /> • impacts created by the granting of the requested variance(s)? <br /> 4. Are there any other issues or concerns with this application? <br /> Planning Staff Recommendation <br /> Planning Staff recommends approval of the hardcover and lake setback variances to accommodate the <br /> changes to the boardwalk to improve safety and comply with accessibility regulations. However,staff <br /> cannot support the expansion of the boat building as practical difficulties are lacking.The City Council <br /> denied the previous request to expand the existing storage shed on the east side of the lakeshore near <br /> the new swimming piers.The Council did not find practical difficulty supporting the expansion of the <br /> existing building on the lakeshore within the 75-foot setback. Instead the Council granted approval to <br /> permit construction of a new changing room building near this boat building (indicated with the blue <br /> arrow on Exhibit D, page 1), outside of the 75-foot setback. <br /> The applicant received a building permit earlier this year to rebuild this storage shed in-kind. The boat <br /> building can be rebuilt in-kind similar to the existing storage shed. If additional storage opportunities <br /> are needed the applicant should consider an expansion to the approved changing room building to <br /> accommodate this storage. If the planning commission identifies practical difficulties which support <br /> the proposed increase to the boat building's footprint and height within the 75-foot setback a <br /> recommendation for approval may be appropriate.
