To-date we have taken the following steps with the city <br /> toward this end: <br /> • Made application for building permits for this addition. <br /> . Discussed, amended and agreed to terms of Orono's Septic System Upgrade Agreement. <br /> • Arranged to comply with the Performance Deposit section of the Septic System Upgrade <br /> Agreement. <br /> This project has the following characteristics and background: <br /> . It is proposed for the highlighted section of the attached land survey, Attachment A. The <br /> improvements shown on the adjacent tract A have not been performed (proposed by a <br /> previous property owner) and are not planned. <br /> . The addition lies 12.5 feet from the existing property line between tracts A and B, which is <br /> non-conforming with the existing two acre zoning which calls for a 30 foot set back. We <br /> believe the project complies with all other set back, site line and hard cover requirements. <br /> • A percolation test for mound system design was performed on the property on November 19, <br /> 1992, by a previous property owner, and an alternate site on Tract A is shown in the <br /> highlighted area on Attachment B. Obviously, we hope and expect this improvement will <br /> never be undertaken, but in the event the sewer does not go through, there appears to be an <br /> alternate site. <br /> . The Bay Ridge neighborhood has unanimously requested a municipal sewer improvement at <br /> the city's earliest convenience. <br /> • Tracts A and B are under common ownership. <br /> Our discussions with Lyle, the building inspector, on the building permit application made it <br /> apparent, we would need to either request a set back variance on Tract B or combine the tracts. <br /> We would rather not combine these tracts so we may maintain future options on this land. <br /> Therefore, we wish to apply for a set back variance on tract B, unless are other alternatives that <br /> preserve the integrity of tract A. <br /> Best regards, <br /> ,n <br /> %��� ;,'�%'� .�, <br /> ,. ,��� J <br /> Kent Whitworth <br />
