Wett and Marge A. Wett, husband and wife, (hereinafter <br /> "the applicants") are the owners of the property located at 1396 Baldur Park Road within the City <br /> of Orono (hereinafter "the City") and legally described as follo�vs: <br /> Lot 16, Baldur Park, Hennepin County, Minnesota(hereinafter "the property"); and <br /> WHEREAS,the applicants have applied to the City for an after the fact variance to <br /> Municipal Zoning Code Section 10.22, Subdivision 1 (B)and Section 10.56, Subdivision 16(L)(2) <br /> to allo�v 3,55�.83 s.f. (36.3%) hardcover iri the 75-250' setback area where 3,555.83 s.£ (36.3%) <br /> exists and 2,4�2 s.f. (2�%)is allowed to permit construction of a four foot overhang over an existing <br /> side�valk on the street side of the residence. <br /> WHEREAS, after due published notice and mailed notice in accordance with <br /> Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning <br /> Commission held a public hearing on April 16, 2001, at which time all persons desiring to be heard <br /> concerning this application were �iven the opportunity to speak thereon. <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br /> Minnesota: <br /> FINDINGS <br /> 1. This application w�as reviewed as Zoning File #01-2669. <br /> 2. This property is located in the LR-1 C Zoning District,where .5 acre or 21,780 s.f. is <br /> the minimum lot area. The properiy consists of approximately .31 acres or 13,670 <br /> s.f. <br /> 3. The Orono Plannin� Commission reviewed this application on April 16, 2001 and <br /> recommended approval by a vote of 5 to 0. <br /> Page 1 of 5 <br />
