The property is located in the LR-1C Zoning District, where 0.5 acres is the <br /> minimum required lot area. The property consists of approYimately 0.27 acres. <br /> 3. The Orono Planning Commission reviewed this application on March 17, 2003 <br /> and recommended approval by a vote of� to 0. <br /> 4. The Plannin� Commission made the following findin�s of fact: <br /> A. The ori�inal structure has been located �vithin this footprint since 1959; <br /> B. The property is unique in that it has lakeshore on the front and rear and almost <br /> all of the lot falls within the required 75' structure setback from the OHWL; <br /> C. The application does not propose to increase the footprint of the structure, <br /> chanae the eYistinj setbacks or chan�e the existin� hardcover; and <br /> D. Additional ��egetative screenin� alon� the lake side of the residence will help <br /> to mitigate the visual impacts of the added height of the structure adjacent to <br /> the lake. <br /> 5. The City Council finds that the conditions existing on this property are peculiar to it <br /> and do not apply generally to other property in this zoning district; that granting the <br /> variances��-i11 not adversely affect traffic conditions,liQht,air,nor pose a fire hazard <br /> or other danger to neighboring property;would not merely serve as a convenience to <br /> the applicant, but is necessary to alle��iate a demonstrable hardship or difficutty; is <br /> necessary to preserve a substantial property ri�ht of the applicant; and would be in <br /> keeping�vith the spirit and intent of the Zoning Code and Comprehensive Plan of the <br /> City. <br /> 6. The City Council has considered this application, including the findings and <br /> recommendations of the Plannin� Commission, reports by City Staff, comments by <br /> the applicant and the effect of the proposed variances on the health, safet}� and <br /> ��-elfare of the community. <br /> CO\CLtiSIO�'S, ORDER, AND CONDITIONS <br /> Based upon one or more of the abo��e findings,the Orono City Council hereby grants variances from <br /> �lunicipal Zoning Code Section 10.22, Subdivision 2;Section 10.�6, Subdivision 16(C)(1); Section <br /> 10.2�, Subdivision 6(B); Section 10.22, Subdi��ision 1(B); and Section 10.56,Subdivision 16(C)(6) <br /> Pa�e 2 of� <br />
