(Lot 30,Block 1 Baldur Park) <br /> Dear Ms. Jenson: <br /> This letter is a follow-up to our scheduled meeting on August 23 which Mr. Weinberger <br /> was una.ble to attend. As we begin working with you on the planning process to expand <br /> our home loca.ted at 1340 Baldur Park Rd, Orono,there are a num�r of issues which we <br /> ask that you,Mr. Weinl�rger and Mr. Barrett consider: <br /> 1. Council Resolution#1415, dated.September 1982,to wlaich you referred,is moot and <br /> irrelevant in that the applicant never owned.or controlled a recorda.ble interest in our <br /> property, Lot 30 together with its easement over Lot 31,yet he was trading <br /> restrictions over Lot 30 in.exchange for variances benefiting proposed Lots 2 and 3 of <br /> the replatting. <br /> 2. Of greater relevance, and more recent, is Council Resolution#2483 of August 1988 <br /> which concerns the closest neighboring residence at 1376 Baldur Pazk Rd. This <br /> resolution granted lakeshore setback and hardcover variances to allow aew <br /> construction 20 feet from the shoreline, hardcover of 30 percent in the 0- 75 ft. zone, <br /> hardcover of 38.9 percent in the 75 -250 ft. zone,and total structural coverage <br /> (house,deck, stairs, garage)of 2,771 sq. ft. or 20.6 percent of the lot azea. <br /> 3. We aze requesting permission to build structural coverage af 15 percent of our lot azea <br /> as allowed by city ordinance. Followin�is an overview of the relevant facts: <br /> • Lot 30,block 1,Baldur Pazk Rd. contains appro�ma�tely 22,000 sq. ft or.51 <br /> acre with an easement over Lot 31 (approxirnately 12,000 sq. ft.)for private <br /> sewer purposes benefiting Lot 30. <br /> � Our home on Lot 30, at its northerly foundation wall, is loca.ted 49.1 ft from <br /> the 929.4(northerly)shoreline elevation,and with decks and gazage, contains <br /> 2,399 sq. ft. of structural hardcover,or approxunately 10.9 percent of the lot <br /> azea. <br /> • The 15 percent rule would allow an additiona1900 sq. ft. of structural <br /> hardcover. <br />
