DRAFT Comprehensive Fire Service Study MEDINA, MINNESOTA <br /> <br />Matrix Consulting Group Page 104 <br />the Minnesota Uniform Municipal Contracting Law; <br />ix. To hire, terminate and discipline employees and administer <br />all other personnel and human resources matters; <br />x. To contract with consultants, including, but not limited to, <br />accountants, auditors, the fiscal agent, engineers, architects, <br />and legal counsel or other services professionals as it <br />determines is necessary and convenient; <br />xi. To manage, own, lease and operate equipment, vehicles, and <br />facilities and buildings; <br />xii. To perform those functions necessary for protection of the <br />public as authorized by law; <br />xiii. To allocate costs to service recipients and make all <br />operational and fire services decisions; <br />xiv. To establish policy and procedures and safety regulations for <br />operations and fire services; <br />xv. To insure and indemnify the Organization, its Members, <br />Board and employees; <br />xvi. To cause reports, plans, studies, and recommendations to be <br />prepared; <br />xvii. To consider applications from additional local units of <br />government for membership in the Organization; <br />xviii. To adopt bylaws, rules, personnel policies, guidelines, and <br />regulations for employees and the operation of the Organization <br />and its vehicles, equipment, facilities and buildings; <br />xix. To annually establish and update a capital improvement <br />program/finance plan (including an equipment replacement <br />schedule) of not less than ten (10) years’ duration; <br />xx. To purchase or lease land, and to cause the construction of <br />buildings to implement the purposes of the Organization, except <br />that any purchase of land or construction of a new building or <br />facility must be approved by all of the Parties respective <br />governing bodies; <br />xxi. To lease or purchase equipment (including capital <br />equipment) and supplies necessary for the proper <br />operation, care, maintenance, and preservation of the <br />Organization; <br />xxii. To incur debt, as allowed by law, and approve financial <br />obligations of the Organization, subject to approval by all of the <br />Parties respective governing bodies; <br />xxiii. To acquire, operate, maintain, replace, and dispose of
