To adopt an ordinance amendment related to appeals <br /> <br />2. Background. In the process of enforcing the zoning code, a property owner desired to exercise <br />his rights to an appeal per section 78-96 administrative appeal. This process allowed for the <br />Planning Commission and City Council to hold a public hearing and review of the issue. The <br />appropriate avenue for appeals of code enforcement action is the Court system. The ordinance, <br />drafted by the city attorney’s office, clarifies this issue. <br /> <br />3. Planning Commission Vote and Comment. The Planning Commission held their public hearing <br />on January 19th. No comments have been received. The Planning Commission voted 6-0 on a <br />motion to approve the amendment as written. <br /> <br />The members of the Commission agreed that the proper avenue for appeal of code enforcement <br />issues was the court system. <br /> <br />4. Public Comment. No comments have been received. <br /> <br />5. Staff Recommendation. Staff recommends the Council adopt the ordinance as written. <br /> <br />COUNCIL ACTION REQUESTED <br />City Council should review the draft ordinance and approve or amend. <br /> <br />Exhibits <br />A.
