The proposed improvement will not result in further extensions into the <br /> substandard yard areas. <br /> C. The vacant lot to the immediate rear of property is legally combined with <br /> developed homestead parcel to immediate south and will not be <br /> developed as a single family residence. <br /> D. The property is served with sewer. <br /> E. The area. and width of this property is consistent with developed lots to <br /> the immediate south and sautheast of property. <br /> F. The property is located immediately west of the City's Old Crystal Bay <br /> Road park. . <br /> G. The City has received no negative comments from property owners <br /> notified of the proposed improvements requiring setback vaxiances. <br /> 4. The City Council finds that the conditions existing on this property are peculiar <br /> to it and do not apply generally to other property in this zoning district; that <br /> granting the variances would not adversely affect traffic conditions, light, air nor <br /> pose a fire hazaxd or other danger to neighboring property; would not merely <br /> serve as a convenience to the applicant, but is necessary to alleviate a <br /> demonstrable hardship or difficulty; is necessary to preserve a substantial <br /> property right of the applicant; and would be in keeping with the spirit and <br /> intent of the Zoning Code and Comprehensive Plan of the City. <br /> 5. The City Council has considered this application including the findings and <br /> recommendations of the Planning Commission, reports by City staff, comments <br /> by the applicant and the effect of the proposed variance on the health, safety <br /> and welfare of the community. <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon one or more of the above findings and hardships, the Orono City <br /> Council hereby grants variances to Municipal Zoning Code Sections 10.03, Subdivision 2 and <br /> 10.25, Subdivision 5 (B) to permit construction of a partial second story over the existing <br /> residence and grants a 3' or 30% separation setback variance, a 21' or 42% rear setback <br /> Page 2 of 4 <br />
