�- <br /> � O� <br /> O O <br /> ��b CITY of ORONO <br /> � � <br /> ti <br /> ti <br /> RESOLUTION OF THE CITY COUNCIL <br /> ��9 4�G NO. � �- � �� <br /> kESII� <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> � Based upon one or more of the above findings, the Orono City Council hereby <br /> Drants variances to Municipal Zoning Code Section 10.03, Subdivision 13 to a11ow the doors <br /> of a detached garage to be located 10' from the lot line where 30' is required, Section 10.28, <br /> Subdivision 5 (B) and Section 10.61, Subdivision 5(A) to allow the side yazd adjacent to street <br /> setback to be 10' from the lot line where 50' is required and Section 10.61, Subdivision 5(A) <br /> to allo�;� a 5' rear lot line setback when 10' is normally required to permit construction of a 588 <br /> s.f. two-stall detached gazage. Approval is subject to the following conditions: _ <br /> 1. Council approval is based on the site plaa submitted by the applicants attached <br /> to this resolution as Exhibit A. Any amendments to the site plan may require <br /> � further Planning Commission and City Council Review. <br /> 2. The gazage is limited to 588 s.f. in order to meet the 15% lot coverage <br /> limitation. <br /> ' 3. The applicants shall remove the historical Wayzata Beach snack hut on the <br /> property within 90 days of receiving the building permit or prior to fmal <br /> inspection, whichever is earlier, so that the properiy will meet the 15% lot <br /> coverage limita.tion. <br /> 4. Authorities granted by this variance run with the property not with the <br /> applicants, but aze pernussive only and must be exercised by application for a <br /> building permit within one year of the date of Council approval, or this variance <br /> will expire on that date (February 28, 2001). <br /> 5. Violation of or non-compliance with any of the terms and coaditions of this <br /> resolution shall constitute a violation of the zoning code, shall automatically <br /> terminate any authority granted herein, and shall be punishable as a <br /> misdemeanor. <br /> • 6. The undersigned applicants have read, understood and hereby agree to the terms <br /> of this resolution and on behalf of themselves, their heirs, successors and <br /> assigns, hereby agree to the recording of this resolution in the chain of title of <br /> the property. <br /> Page 3 of 6 <br />
