'oho <br /> To: Chair Ressler and Planning Commission Members e' <br /> Ron Olson, Interim City Administrator .N, <br /> A. <br /> ti <br /> N. <br /> From: Jeremy Barnhart,AICP �' <br /> kEsHO� <br /> Community Development Director <br /> Date: March 15, 2021 <br /> Subject: #LA20-000047, City of Orono Text Amendment related to Boat storage <br /> Public Hearing <br /> Application Summary: The City is contemplating an ordinance amendment related to the <br /> storage of recreational equipment, including boats and boat trailers, on residential property. <br /> Staff Recommendation: Planning Department Staff recommends approval of the ordinance as <br /> drafted. <br /> Background/Problem <br /> The City Prosecuting Attorney has identified challenges to the enforcement of the regulations <br /> related to boat and boat trailer storage,and has recommended the City amend the ordinance to <br /> address these issues. The City Council has further directed staff that any resulting changes be <br /> easy to understand; understandable regulation is easier to follow. The Council noted that <br /> residents of a lake community should expect some level of boat storage in residential districts. <br /> Solution <br /> The draft ordinance is attached as Exhibit A. The ordinance includes the entire "Exterior storage <br /> in R districts" regulations for context,though changes are proposed only in the boat storage <br /> subparagraph. <br /> The draft regulation removes the operable condition requirement, as this is difficult to prove, <br /> especially over a two year period. The revision does require currently licensed to the owner or <br /> occupant of the property,which should address storage of boats as a side business, or concerns <br /> with boat density on a property. The code removes the length limitation, and establishes a <br /> minimum setback from property lines of 5 feet. The Commission should discuss if the storage of <br /> boats in any specific yards is inappropriate. <br /> Some cities has broken down the storage regulations depending on the season,though care <br /> should be exercised to ensure the regulation and its underlying goal is understandable and <br /> achievable. The ordinances for Medina, Mound, and Excelsior are attached. <br /> Public Comments <br /> To date, no public comments have been received, though one resident has requested a draft of <br /> the ordinance. <br /> Issues for Consideration <br /> 1. Does the Commission suggest any yards as off limits for boat storage? <br />
