gOATO CITY OF ORONO <br /> RESOLUTION OF THE CITY COUNCIL <br /> NO. 7175 <br /> /Qs H <br /> O <br /> A RESOLUTION <br /> APPROVING A VARIANCE FROM <br /> MUNICIPAL ZONING CODE <br /> SECTION 78-330 and 78-1279 <br /> FILE NO. LA21-000012 <br /> WHEREAS, on February 2, 2021, Clairmont Design Build ("Applicant"), applied <br /> for variances from the City Code for the property addressed 1260 Spruce Place and legally <br /> described as: <br /> Lot 1, Block 10, Saga Hill Revised, Hennepin County, Minnesota, together with <br /> that part of vacated Lake Street adjoining said Lot 1, Block 10, as shown on the survey <br /> attached to Notice of Vacation on Book 848 of Miscellaneous, Page 596, Document No. <br /> 3213583 filed in the office of the Register of Deeds, Hennepin County, Minnesota <br /> (hereinafter the "Property"); <br /> WHEREAS, the Applicants have made application to the City of Orono for a <br /> variance to Orono Municipal Zoning Code Section 78-330 to allow a 2nd floor addition within the <br /> side yard setback; and <br /> WHEREAS, the Applicants have made application to the City of Orono for a <br /> variance to Orono Municipal Zoning Code Section 78-1279 to allow a 2nd floor addition within the <br /> average lakeshore setback and within the 75 foot lakeyard setback; and <br /> WHEREAS, on February 16, 2021, after published and mailed notice in accordance <br /> with Minnesota Statutes and the City Code, the Planning Commission held a public hearing, at <br /> which time all persons desiring to be heard concerning this application were given the opportunity <br /> to speak thereon; and <br /> WHEREAS, on February 16, 2021 the Planning Commission recommended <br /> approval of the variance; and <br /> WHEREAS, on March 8, 2021, the City Council reviewed the application and the <br /> recommendations of the Planning Commission and City staff; and <br /> WHEREAS, on March 8, 2021, the City Council directed preparation of findings for <br /> approval of the variance. <br />
