9. The conditions do not apply generally to other land or structures in the district in which <br /> said land is located. <br /> Response: The location of the neighboring homes, the character of the lake shoreline, the creek on <br /> the Property, and the vacancy of the adjacent property, are all unique conditions affecting the <br /> Property <br /> 10. The granting of the application is necessary for the preservation and enjoyment of a <br /> substantial property right of the applicant. <br /> Response: The variance is necessary to preserve the right to build a home on the Property. <br /> 11. The granting of the proposed variance will not in any way impair health, safety, <br /> comfort, morals, or in any other respect be contrary to the intent of the Zoning Code. <br /> Response: Granting the requested variance will not adversely impact health, safety, comfort, or <br /> morals; nor will it be contrary to the intent of the Code. <br /> 12. The granting of such variance will not merely serve as a convenience to the applicant <br /> but is necessary to alleviate demonstrable difficulty. <br /> Response: The application of the average lakeshore setback on the Property severely limits the <br /> options for building a home; the granting of the requested variance is necessary to alleviate a <br /> practical difficulty resulting from the location of the neighboring homes, the character of the lake <br /> shoreline, the creek on the Property, and the vacancy of the adjacent property. <br />
