°Ivo <br /> To: Chair Ressler and Planning Commission Members <br /> Ron Olson, Interim City Administrator <br /> y � <br /> F L� <br /> From: Jeremy Barnhart,AICP 4kESH0f" <br /> Community Development Director <br /> Date: January 19, 2021 <br /> Subject: #LA21-01, City of Orono Text Amendment related to appeals <br /> Public Hearing <br /> Application Summary: The proposed text amendment will guide the process for appeals of <br /> decisions of the city differently than appeals from code enforcement action. <br /> Staff Recommendation: Planning Department Staff recommends approval as drafted. <br /> Issue <br /> An interested party has the right to appeal decisions made by the city, outlined in several <br /> sections of the code, depending on the source of the regulation to be appealed. <br /> In the course of administering code enforcement activities, however,the appropriate appeal <br /> process is through the court system. The City Code is not clear on this issue. <br /> Solution <br /> The City Attorney recommends amending the city code with the proposed text to clarify the <br /> appeal process when responding to potential criminal,civil,or administrative penalties. <br /> Public Comments <br /> To date, no public comments have been received. <br /> Issues for Consideration <br /> 1.
