The Planning <br /> Commission should determine if the average lakeshore setback variance is supported by <br /> practical difficulty and make a recommendation. <br /> Background <br /> The applicant is asking for an average lakeshore setback to allow for a chimney for a wood <br /> burning fireplace to be constructed lakeward of the average lakeshore setback along the north <br /> side of the new home. This property received an average lakeshore setback variance and <br /> hardcover variance in 2019 (LA19-000048)to construct a new home. At that time a chimney <br /> was anticipated on the south side of the property behind the average lakeshore setback. <br /> The applicant has received a building permit for a new home (RPS20-000142)with the chimney <br /> removed from the plans,which meet the approved variances and city codes. <br /> Practical Difficulties Analysis <br /> Applicant Submittal Information:The applicant has identified the extreme average lakeshore <br /> setback as practical difficulties supporting the requested variance. Additionally,they have <br /> provided supporting documentation regarding Practical Difficulties attached as Exhibit B, and <br /> should be asked for additional testimony regarding the application. <br /> Planning Staff Practical Difficulty Analysis: Regarding practical difficulty,Staff finds the variances <br /> previously granted for the property allow for construction of a new home and allows for a <br /> reasonable use of the property. A chimney would act as an amenity and not necessary to the <br /> use of the property for a single family home.
