McCarron I am writing this letter as a follow up to our conversation regarding the <br /> Also c;«<, �r in W7,cans,n structure located on the above-described lot. You have inquired as to whether the <br /> City must issue building permits for this structure based on its legal non-conforming <br /> status. As you are aware, a legal non-conforming structure may be repaired or <br /> restored pursuant to Minnesota statute 462.357, subd. le., and Orono City Code <br /> section 78-71. However, a property owner does not enjoy the rights to repair or <br /> restore a non-conforming structure pursuant to these provisions if the non-conformity <br /> or occupancy of the structure is discontinued for a period of more than a year. In <br /> addition, the statutory provision governing non-conformities and City Code section <br /> 78-1136 prohibits the alteration and addition to a non-conforming structure if it <br /> results in an increase in the flood damage potential or increases the degree of <br /> obstruction to the flood flow in the floodway.
