v. 0.41- ' <br /> 0 0CITY of ORONO <br /> ,, OA G RESOLUTION OF THE CITY COUNCIL <br /> `1kEstIO NO. 5 8 9 5 <br /> applicants; and would be in keeping with the spirit and intent of the Zoning Code <br /> and Comprehensive Plan of the City. <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon one or more of the above findings, the Orono City Council hereby grants a <br /> variance to Orono Municipal Zoning Code Section 78-330 (B) to allow redevelopment on a lot <br /> 0.34 acre in area where 1.0 acre is normally required, and contains 56 feet in width at the OHWL <br /> and 45 feet in width at the 75 foot setback where 140 feet is normally required; and a variance to <br /> Section 78-330 (B) to allow a 9.7' setback from the south side lot line where a 10' setback is <br /> normally required; and a variance to Section 78-330 (B) to allow an 8' yard setback from the rear <br /> lot line where a 30' setback is normally required; and a variance to Section 78-1288 to allow <br /> 67.3% hardcover within the 250'-500' zone where 30% is normally allowed in order to construct <br /> a new residence, subject to the following conditions: <br /> 1. Council approval is based on the site plan/survey and building plans submitted by the <br /> applicants and annotated by City staff, attached to this Resolution as Exhibit B & C. Any <br /> amendments to the site plan which are not in conformity with City codes will require <br /> further Planning Commission and City Council review. <br /> 2. Hardcover in the 0-75' zone shall not increase above the level of 0 s.f. or 0%. Hardcover <br /> in the 75-250' zone shall be limited to 1,962 s.f. or 25%; and hardcover within the 250'- <br /> 500' zone shall be limited to 1,753 s.f. or 67.3% per the proposed plan and hardcover <br /> allowance summary as depicted on Exhibit B. Applicants are advised that any future <br /> requests to increase hardcover or change the nature of existing/approved hardcover shall <br /> require City approval, and increases in hardcover will not likely be approved without <br /> concurrent reduction in existing hardcover. <br /> 3. ADDITIONAL SURVEYS REQUIRED: <br /> a. Per City Code Section 86-68, a foundation survey is required to be submitted <br /> prior to commencement of framing; and <br /> b. An as-built grading plan verifying compliance with the building permit, <br /> stormwater management, grading and drainage plans shall be submitted prior to <br /> the issuance of a Certificate of Occupancy for the residence. <br /> 4. The building plans submitted for building permit will be reviewed to ensure compliance <br /> with the City's building height and number of stories regulations. <br /> Page 3 of 5 <br />
